Weber Rewards Scheme Terms & Conditions

The Weber Rewards Loyalty Scheme (the "Scheme") is a points based customer loyalty programme open to customers buying Weber products meeting the eligibility criteria of the Scheme (see below). The Scheme is owned by Saint-Gobain Construction Products UK Limited trading as Saint-Gobain Weber ("Weber"/"the Company") and are registered in England and Wales under company number 734396 and have our registered office at Saint-Gobain House, East Leake, Loughborough, Leicestershire. LE12 6JU. [VAT number is GB438 306 550]. The Weber Rewards Loyalty scheme is operated on behalf of Weber by a third party being A&I Events Limited

These rules including our Privacy Statement, Website Terms of Use, and Acceptable Use Policy (the "Rules") govern the collection and use of electronic points issued under the Scheme (the "Rewards Points"). To participate in the Scheme you must comply with these Rules, which you should read carefully.

From time to time, we may restrict access to some parts of our site, or our entire site, to users who have registered with us.

1. Eligibility

1.1 To be eligible to join the Scheme and earn/collect Rewards Points, you must have purchased one or more of the qualifying products manufactured by Weber which display a sticker on the outside containing a unique code. You must also be over 18 years old (if an individual) and have an address in the UK, the Isle of Man or the Channel Islands.

1.2 To register to join the Scheme, you need to register your details on the www.loveweber.co.uk website. You will be asked a number of compulsory questions which you will need to complete.

1.3 If an application to join the Scheme is accepted, an account will be created for you (a "Weber Rewards Account") and the Company will issue you with the necessary login details to access your Weber Rewards Account (your "Log-in Details"). These details will be issued electronically.

1.4 Subject to Rules 1.3 and 1.5, each registered participant is entitled to one set of Log-in Details. Where the registered user is a corporate body, a partnership or other organisation it will be the responsibility of that party to determine who has access to the Scheme.

1.5 The Company reserves the right to refuse a registration application to the Scheme at any time at its absolute discretion. The following parties (among others) do not qualify to participate in the Scheme. By accepting the terms and conditions you confirm that you do not fall within any of the following categories:

a) Employees of the Company or of its subsidiaries, holding company or such companies 'subsidiaries or holding companies (as the same are defined under s1159 of the Companies Act 2006);

b) Employees of existing Weber product stockists/distribution centres

c) Relatives of any such employee; and

d) Any Public Authority or other Public Sector Organisation.

2. Collecting Rewards Points

2.1 To be able to start collecting points under the Scheme you must first have registered and been approved as a participant of the Scheme and have activated your Weber Rewards Account by entering the Log-in Details provided to you by the Scheme administration team. To add Weber Rewards points to your account, you need to remove the sticker from the Weber product you purchase and enter the code on Weber's website www.loveweber.co.uk.

2.2 Once registered and you have added at least 1000 Weber Rewards points to your account each new member will receive a welcome pack.

2.3 The Company will maintain your Weber Rewards Account that records your Rewards Points (being the electronic currency) awarded to Scheme participants in accordance with the Weber Rewards Points Policy. The Company may send you details of the number of Rewards Points held by you from time to time and you will be able to view the amount of Rewards Points held by you by logging into the Scheme website www.loveweber.co.uk (the "Scheme Website") with your Log-in Details.

2.3 Once registered you can collect Rewards Points by entering the unique code from the sticker contained on each qualifying Weber product that you purchase into your Weber Rewards Account on the website. The system will recognise the unique code on the product and allocate the relevant number of Rewards Points for that product to your Weber Rewards Account. Once the unique code has been registered it cannot be used again.

2.4 Each unique code is valid for 24 months and must be scanned within this time. Any points not scanned within this time will be forfeited and you will not be entitled to any compensation or damages from Weber and/or A&I Events Limited.

2.5 The Company will correct any mistakes that are made in respect of the number of Rewards Points issued to you but recommends that you keep records of your transactions so that you can check that the information held is accurate

3. Membership

3.1 Subject to your application to the Scheme being approved, the address that the system will hold will be the address that you have provided at the point of registration. If you change your address, you must email the Scheme administrators on info@loveweber.co.uk. Alternatively, you may go online at www.loveweber.co.uk and update your address details yourself.

3.2 You are the holder of your Rewards Points and are responsible for their security. Weber is the overall owner of all Rewards Points and they remain its property at all times, until redeemed by you as the Weber Rewards Account holder.

3.3 It is your responsibility to keep secure any information that might identify you and allow access to your Weber Rewards Account. Neither Weber nor A&I Events Limited will take responsibility if a person is able to spend any Rewards Points as a result of you not taking proper care of your Weber Rewards Account details. If you lose or accidentally reveal your Log-in Details you should immediately contact the Scheme administrators at: info@loveweber.co.uk

3.4 You cannot transfer, sell or use your Rewards Points for any purpose except as permitted under these Rules (which for the avoidance of doubt shall include any transaction under Rule 4 or Rule 5). If you try to transfer Rewards Points in any way that is not permitted by these Rules, Weber may take action against you.

3.5 Your Weber Rewards Loyalty Scheme account will be deactivated after 12 consecutive months of inactivity and all Reward Points will be removed from your accounts (see Weber Rewards Points Policy for further details).

4. Redeeming your Rewards Points

Rewards Points will be added into your Weber Rewards Account as and when you enter your unique code found on the stickers from the qualifying Weber products.

4.1 Rewards Points will be redeemed in the order in which they were accrued.

4.2 Rewards Points must be redeemed within 24 months of the date of the Allocation Date (as defined in the Weber Rewards Points Policy). Any points not redeemed within this time will be forfeited and you will not be entitled to any compensation or damages from Weber and/or A&I Events Limited.

4.3 Rewards Points can be redeemed against goods or services promoted on the Scheme Website provided that all such products are available. In the event that a promoted product is not available at any time an alternative product will be sent out of equivalent value.

4.4 Despite A&I Events Limited's best efforts, some products advertised on the Scheme Website may have been attributed with the wrong number of Rewards Points payable. If this is the case the Company will contact you to determine how best to proceed. For the avoidance of doubt there will be no obligation on Weber and/or A&I Events Limited to provide products for the number of Rewards Points advertised where there has been an error made by A&I Events Limited or any third party.

4.5 Weber reserves the right to change the products or the points attributable to any of the products at any time and without notice.

4.6 It is acknowledged that some of the transactions on which the Rewards Points are redeemed are made directly with third party merchants (the "Suppliers") who may offer links to their websites via the Scheme Website. Neither A&I Events Limited nor Weber are responsible for these sites, nor for any product information or services supplied through or in connection with them. Neither Weber nor A&I Events Limited has responsibility for the standard, quality or otherwise of any goods or services received or supplied or the failure of any Supplier to honour a redemption. Any dealings that you may enter into with any Supplier or other third party will be solely between you and that Supplier or other third party including any transaction for the purchase of products from such Suppliers or other third parties. All such dealings will be subject to the Supplier or other third party's terms and conditions and privacy policies applicable to such transactions.

4.7 All rewards are supplied with and are subject to the manufacturer's warranty. Weber and/or A&I Events Limited shall have no responsibility for the standard, quality or otherwise of any rewards.

4.8 Redeemed Rewards Points cannot be used again. If a transaction on which Rewards Points are redeemed is cancelled, reversed or not completed, where appropriate we will reverse the associated Rewards Points movement when instructed by the relevant Supplier.

4.9 No change to a reward can be made by the Customer after it has been booked or fulfilled in accordance with the information submitted on the on-line redemption form. In the event that the Customer is unable to make use of their Reward through illness or other circumstance beyond their control, Weber and/or A&I Events Limited will endeavour to assist the Customer in re-booking the Reward, where possible, but any additional costs incurred will be payable by the Customer.

4.10 If the Customer wishes to amend their reward in any way, such as extending their stay or adding additional participants to an experience, the Customer must state this when claiming their reward. Weber, A&I Events Limited and their suppliers will endeavour to provide suitable arrangements and will require the Customer to pay any additional costs before such arrangements can be made.

4.11 Those participating in motoring-based rewards must hold a current full and valid UK driving licence.

4.12 Weber and/or A&I Events Limited will use reasonable endeavours to deliver the rewards to your nominated address within 21 days of the date of claiming. However, due to the exclusive nature of these rewards, despatch is subject to stock availability and no liability is accepted for late delivery.

4.13 Weber and/or A&I Events Limited accepts no responsibility for rewards lost or delayed in the post. Weber shall also not be responsible where a third party fails to issue a reward.

4.14 The Rewards Points have no monetary value and cannot be exchanged for cash.

5. Products

5.1 Some products will be supplied by Weber and others will be provided by third parties in accordance with clause 4.6 above.

5.2 From time to time Weber may offer additional points for special offers which will only be available for acceptance for a limited period of time following particular instructions in accordance with the terms of the special offer.

6. Travel Rewards

6.1. When redeeming holiday or tour rewards, the Customer's details will be passed to Weber's and/or A&I Events Limited tour operator who are ATOL/ABTA license bonded and will usually make direct contact with the nominated person within 14 days.

6.2. All holiday, experience, tours and other travel rewards are subject to the agent's booking conditions and cancellation charges that will be made available at the time of booking.

6.3. The Customer is responsible for passport, visa, insurance, and where relevant return transport between home and airport or destination and any other incidental costs such as airport parking. Weber's and/or A&I Events Limited agent may request sight of the Customer's insurance arrangements before issuing any holiday documentation.

6.4.Travel related rewards will exclude travel over all school holiday periods and bank holidays. All travel rewards are offered subject to availability and travel must be completed within 12 months of the date of the Customer's claim, or sooner if otherwise stated on a specific reward.

6.5. All holiday, experience, tours and other travel rewards are for the number of people stated on the rewards description on the Website. If the Customer wishes to include additional adults or children on any of the holiday rewards, the travel company may be able to arrange this. The additional cost involved will be payable direct to the travel company and Weber and / or A&I Events Limited accepts no liability for such additional arrangements.

7. Closing/ Ending your Weber Rewards Account

7.1 You can choose to withdraw your participation of the Scheme at any time by contacting the Scheme administration team on info@loveweber.co.uk.

7.2 Weber may terminate your participation on the Scheme and cancel or suspend any Rewards Points in your Weber Rewards Account by notifying you in writing if Weber reasonably believes that:

a) you have acted in a way that harms Weber, A&I Events Limited, the Scheme or any third party supplier;

b) you engage in any illegal or fraudulent activities;

c) you collect or redeem Rewards Points dishonestly or in a way that breaks these rules;

d) you have acted in a hostile, abusive or aggressive manner towards any of Weber, A&I Events Limited or any third party supplier staff;

e) you have knowingly provided Weber or A&I Events Limited with false or misleading information;

f) you have breached any of the terms relating to your Weber Rewards Account or if you are a Weber trade account holder and you have breached the terms of that trade account;

g) you have had a zero balance on your Weber Rewards Account for a consecutive 6 month period.

7.3 In the event that your Weber Rewards Account is withdrawn from the Scheme or is terminated at Weber's discretion your right to use any accumulated Rewards Points will be forfeited and you will not be entitled to any compensation or damages from Weber.

8. Liability

8.1 Neither A&I Events Limited nor Weber are liable for the acts and failures of any Supplier or other third party. Extra terms may apply to any goods or services that you purchase from a Supplier or other third party and it is your responsibility to make a note of these and to ask for more details before redeeming your Rewards Points if necessary.

8.2 Neither A&I Events Limited nor Weber are liable for any failures due to unusual and unexpected circumstances beyond their control, the consequences of which could not have been avoided even if they had taken all necessary care (for example, industrial disputes, hostilities, political unrest or natural disasters).

8.3 Nothing in these Rules limits or excludes Weber's nor A&I Events Limited's liability for death or personal injury caused by its negligence or for fraudulent misrepresentation

9. General

9.1 Weber may change any element of the Scheme including the Weber Rewards Points Policy and these Rules at any time without your consent by publishing the changes on the Scheme Website.

9.2 Weber is not liable for any tax liability that may arise from you taking part in the Scheme.

9.3 The Scheme is a stand alone promotion and does not amend normal terms and conditions of trading as between Weber and its customers which will continue to apply.

9.4 These Rules are governed by the laws of England and are subject to the non-exclusive jurisdiction of the English Courts.

Where you are a consumer living in Ireland:

a. if you live in the Republic of Ireland then Irish law will apply and you may bring any dispute in the Irish courts; or

b. if you live in Northern Ireland then Northern Irish law will apply and you may bring any dispute in the Northern Irish courts.

Any English law citations in these terms and conditions will be substituted for the equivalent Irish or Northern Irish citation in accordance with the terms of this jurisdiction clause.

10.0 Data Protection

10.1 For the purposes of this clause, (a) "Data Protection Laws" means any laws and regulations relating to the use or processing of personal data including: (i) retained EU law version of the General Data Protection Regulation (EU) 2016/679 ("UK GDPR") (ii) any laws or regulations ratifying, implementing, adopting, supplementing or replacing the UK GDPR; (iii) the Data Protection Act 2018 ("DPA") and (iv) any laws and regulations implementing the Privacy and Electronic Communications Directive 2009/136/EC) and the Privacy and Electronic Communications Regulations 2003 (SI 2009/2426) in each case, as updated, amended or replaced from time to time; and (b) the terms "Data Subject", "Personal Data", "processing", "processor" and "controller" shall have the meanings set out in the UK GDPR.

10.2 Each party shall comply with the provisions and obligations imposed on it by the Data Protection Laws when processing Personal Data in connection with these terms and conditions. Such processing shall continue for so long as these terms and conditions are in force and shall be in respect of the following:

10.2.1 Categories of data: Contacts within each of the parties and the ultimate customer details;

10.2.2 The types of data we hold relating to you are as follows:

  • Name;
  • Company for whom you work;
  • Address;
  • Email address(es);
  • Telephone number(s);
  • Date of birth;
  • Your signature;
  • Technological data (IP addresses and cookies – please see section 10 of our Privacy Statement https://www.uk.weber/privacy-statement on how we use cookies for further information);
  • Geo-location data when you sign for delivery using a mobile device;
  • Correspondence or other communications with you about our products, services or business;
  • Weber Rewards Account history (date of registration, current Weber Rewards points, current treat goal, Weber Rewards gift redemptions).

10.2.3 Purpose and nature of processing: (i) manage the Contracts between the parties including ordering, fulfilment and billing and (ii) fulfilment of such Contracts by delivering Goods to the ultimate customer on behalf of the Customer.

10.3 To the extent that a party processes any Personal Data on behalf of the other party, the processing party shall:

a. comply with the provisions and obligations imposed on a processor by UK GDPR, including the stipulations set out in Article 28(3)(a)-(h) which form a part of, and are incorporated into, these terms and conditions as if they were set out in full, and the reference to "documented instructions" in Article 28(3)(a) shall include the provisions of these terms and conditions; and

b. not disclose any Personal Data to any Data Subject or to a third party other than at the written request of the other party or as expressly provided for in these terms and conditions.

10.4 The Customer agrees that Weber may engage third party providers including any advisers, contractors, or auditors to Process Personal Data ("Sub-Processors"). Weber shall ensure that its contract with each Sub-Processor shall impose obligations in relation to the Processing of Personal Data on the Sub-Processor that are materially equivalent to the obligations to which Weber is subject to under these terms and conditions in relation to the Processing of Personal Data.

Weber Rewards Points Policy

This Weber Rewards Points Policy should be read alongside the Weber Rewards Scheme Terms & Conditions (the "Rules"). Terms defined in the Rules shall have the same meanings when used in this Weber Rewards Points Policy.

2. From time to time Weber may run double or triple point promotions. Where such promotions are being run, the number of Rewards Points to be issued will be calculated and allocated on a monthly basis.

3. Rewards Points will be deemed to have been issued on the date on which the new balance is displayed on the Website (the "Allocation Date").

4. All Rewards Points will be removed from deactivated Weber Rewards Loyalty Scheme accounts 3 months after deactivation.

5. In the event that a credit note is issued to you, your entitlement to Rewards Points will be reduced accordingly and Weber or A&I Events Limited may, if the Rewards Points have already been issued, amend your Weber Rewards Account balance accordingly. In the event that the Rewards Points have already been redeemed by you, Weber or A&I Events Limited shall be entitled:

5.1 to prevent you from redeeming any further Rewards Points until the deficit has been made up; or

5.2 where it has reason to believe that you have acted dishonestly or fraudulently, require you to reimburse Weber or A&I Events Limited for any expense that it has incurred relating to the redemption of such Rewards Points.
